Form I-9 requires that employers verify the employee’s identity and his or her authorization to work in the United States. Employers must complete an I-9 form within three business days of the employee’s first day of employment. Employers need to verify the employee’s documents and perform internal audits (company-initiated audits) to ensure that they are in compliance with U.S. Immigration and Customs Enforcement (ICE). For example, employers should have a compliance program in place which includes what to ask prospective employees, how to authenticate documents, and how to re-verify authorization. Internal I-9 audits are critical and are on ICE’s Best Employment Practices List. Furthermore, occasional internal audits are the best defense against Department of Homeland Security audits.
